LOS ANGELES (AP) ? Arnold Schwarzenegger is confirming that he had a "hot affair" with actress Brigitte Nielsen at a time he and Maria Shriver were dating and already living together.
Schwarzenegger and Nielsen co-starred in the 1985 film "Red Sonja." Nielsen write in a memoir published last year that she and Schwarzenegger had an "outrageous affair" while making the movie and that she did know until later that he was involved with Shriver.
In his memoir "Total Recall," coming out Monday, Schwarzenegger writes that he and Nielsen did indeed have a "hot affair," but he knew it wouldn't last. In fact, their "fling" only made him realize that he wanted to marry Shriver.
Nielsen would soon marry Schwarzenegger's fellow action star, Sylvester Stallone.

A meeting is scheduled in Lexington Oct. 16 for creditors of Thoroughbred Times Company Inc., which filed for Chapter 7 bankruptcy protection Sept. 14 and ceased operations of the Thoroughbred magazine and website. According to the notice sent to creditors, the meeting will take place at 1:20 p.m. Oct. 16 at Community Trust Bank Building at 100 E. Vine Street in Lexington. The sudden bankruptcy filing and closing of Thoroughbred Times by owner Norman Ridker left the company?s 27 employees without jobs. The filing, in which Ridker is seeking to dissolve the company and sell its assets, listed $5.3 million in liabilities and just under $1 million in assets. BowTie Inc., a publishing company owned by Ridker, is listed as being owed $2.48 million and Ridker personally is owed $1.9 million, according to the bankruptcy filing. Also, an Irvine, Calif., company called Global Distribution Services is owed $418,020, according to the filing. Global is a division of BowTie Inc., and Ridker is listed as part of the company?s management team. Among the Thoroughbred Times Co. assets are $883,661 in accounts receivable, according to the filing. J. James Rogan of Danville, Ky., has been named bankruptcy trustee in the case. The notice to creditors about the Oct. 16 meeting notes "the debtor?s representative must be present at the meeting to be questioned under oath by the trustee and by creditors. Creditors are welcome to attend, but are not required to do so." The notice also instructs creditors not to file a proof of claim at this time, noting, "There does not appear to be any property available to the trustee to pay creditors. If it later appears that assets are available to pay creditors, you will be sent another notice telling you that you may file a proof of claim, and telling you the deadline for filing your proof of claim." ?

Once the filing has been finished, the petitioner may want to take steps to rebuild credit. Many persons exiting a filing will begin with the purchase of a used vehicle. For how long will Warren defenders maintain the charade that she did not practice law in Massachusetts?
In my post on September 24, Elizabeth Warren?s law license problem, I detailed how Elizabeth Warren had used her Harvard office in Cambridge?for the practice of law for over a decade in numerous cases in which she appeared as ?Of Counsel? or counsel, and how she identified that office in filings with various courts.
Even though Warren refused to disclose the full extent of her legal practice, I argued that her use of the office in Cambridge for the practice of law, and?her systematic and continuous presence in Massachusetts for the practice of law, would be a violation of Massachusetts law since she was not licensed in Massachusetts.
In response, defenders of Warren tried to make distinctions which make no difference to whether Warren improperly maintained an office for the practice of law or a systematic and continuous presence in Massachusetts for the practice of law.
Warren defenders argued that if she only represented non-Massachusetts clients in non-Massachusetts cases which did not involve Massachusetts law, she was not practicing law ?in Massachusetts? even if she was practicing law in Cambridge.? Other strawman arguments included that as long as Warren complied with federal court admission requirements, Massachusetts could not require her to be licensed.? For reasons I have explained, those arguments are wrong.
Warren defenders were bolstered by the unusual ?personal? commentary offered by Michael Fredrickson, the General Counsel of the Massachusetts Board of Bar Overseers which seemingly exonerated Warren, even though Fredrickson admitted he was just ?speaking hypothetically? and not specifically as to Warren because ?I know so little about Elizabeth Warren and her practice.?
Despite the pushback, the point of my original post is growing stronger with each passing day.? Even the author of a post at The League of Ordinary Gentlemen, which has been cited as the definitive rebuttal, has admitted:
??I want to make clear that I agree with Jack Marshall that Jacobson?s allegations are being treated with insufficient seriousness by Warren?s sympathizers.? That neither she nor her campaign have directly responded to the allegations is disappointing and irresponsible at minimum.? In the last few days, my post has been linked far and wide as if it were the definitive debunking of Jacobson?s allegations.? While I stand by my arguments, neither my original post nor my additional arguments below are exactly a detailed ethics opinion, either.? In particular, as Jacobson?s response correctly notes, I did not attempt to address his central argument that Professor Warren maintained a ?systematic and continuous? presence in Massachusetts for the practice of law?.
Similarly, Jack Marshall at Ethics Alarm writes:
? I am dismayed, if not shocked, that the legal establishment, as well as legal ethicists who should know better, are letting their political biases dictate their analysis. It is true that Jacobson is an openly conservative blogger as well as a long-time critic of Warren, but he raises legitimate questions that deserve to be taken at face value, whatever their source. The fact Fredrickson, the BBO General Counsel, felt it necessary to personally defend Warren in the absence of sufficient facts strongly suggests a pro-Warren bias in the disciplinary system, where it really shouldn?t matter who breaks the rules, but whether or not they have.
In just the last few days even more information has come forward which supports my original position.? We learned that Warren represented to the Texas Bar that her ?primary practice location? was in Cambridge.
We also learned that Warren had a law practice going beyond brief writing, including being hired to provide legal advice to various creditors? committees in bankruptcy cases, in which she represented to the Court that?her ?Billing Statement is in the same form regularly used by Professor Warren to bill her clients? and in which the work was performed, at $675 per hour as of 2002, from her Cambridge office.? There will be more such examples detailed in coming days.
Yet still, Warren defenders persist in defending on the basis that Warren just wrote a few Briefs for out of state cases and never did anything for a Massachusetts client?in Massachusetts, much less?on a Massachusetts issue of law.
I consider that test irrelevant, but in any event, Warren did represent a Massachusetts client in Massachusetts on a Massachusetts legal issue.
The case was an appeal in the First Circuit Court of Appeals in Boston in the case of Cadle Company v. Schlictmann.
The case involved a?dispute as to a lien on a contingent fee earned by Beverly, Massachusetts lawyer Jan R. Schlichtmann, who was the subject of the film A Civil Action.? The issue in the case was whether a creditor or Schlictmann was entitled to the contingency fee earned in a case which started prior to Schlictmann?s personal bankruptcy but did not conclude until long after the bankruptcy.
The lien enforcement arose out of?state law.? Even though there were bankruptcy related issues, the question was whether the?state law lien survived.? As noted on the court docket and in the ultimate decision, the case only was in federal court because of what is called ?diversity jurisdiction,? which permits a plaintiff to file in federal court if the plaintiff is a citizen of a different state than any of the defendants, and the dollar amount exceeds a minimum threshold (now $75,000).
The First Circuit ruled in favor of the creditor.
Based on the First Circuit docket available through PACER, it appears that Warren and three other Harvard Law professors were brought in to try to convince the First Circuit to reconsider its decision.? The Schlichtmann representation is not a case previously disclosed by the Warren campaign.

The docket entry leaves some unanswered questions, specifically on what basis and using what license Warren entered her appearance.? There does not appear to be any request by Warren for permission to appear in the case.? Perhaps some enterprising reader can dig out the First Circuit appearance rules as they existed in August 2001, when Warren entered her appearance.
Regardless, the issue is not whether Warren was authorized?under First Circuit rules?to enter an appearance in the First Circuit.? That is the strawman issue used by Warren defenders to distract.
The issue is whether Warren defenders can continue to?maintain the charade that she did not maintain an office for the practice of law, or maintain a ?systematic and continuous presence??in?Massachusetts for the practice of law.
Warren defenders have proposed the standard that Warren never represented a Massachusetts client in Massachusetts or on any issue involving?Massachusetts state law. ?Now we know she did.

The fire flared up Saturday on Reeder Street near Maryland Parkway and Hacienda Avenue. Polo Rodriguez and his family were celebrating his son's birthday and baptism.
About a dozen people were at the home for the celebration when a deep fryer was accidentally knocked over. The flames engulfed two 4-year-old children. Family members said Rodriguez ran in to save them.
"He was in flames, not worrying about himself, and picked up both of them and came out, that's what a dad does, any dad would do that, not just because it was him, any mother too," said Margarita and Alex Rodriguez, sister and brother-in-law.
Rodriguez's wife, Claudia, is in serious condition. She also went back into harms way, looking for the children. The two children remain hospitalized in critical condition. Both has undergone three surgeries since Saturday.

FCC Chairman Julius Genachowski spoke today on the state of U.S. broadband. He didn?t break new ground, but he did push for faster and higher capacity broadband in the U.S. The question is whether he plans to get the agency to do anything about it.

In a speech Tuesday, Julius Genachowski did what I?m beginning to think of as the ?Julius shuffle?, where he takes two steps forward calling for innovation, competition and better broadband and then fails to deliver with policies that might enrage the major wireline and wireless ISPs. But the fundamental question to ask after his speech and ahead of the close of a comment period on how the FCC measures broadband in the U.S. is: what will the new broadband math look like?
Genachowski?s prepared remarks on Tuesday focused on how competitive the U.S. isn?t when it comes to global broadband rankings, unless we?re talking about mobile, which the U.S. is rocking at because we have the most subscribers on LTE networks. The speech covered the basics of this administration?s efforts in broadband ? highlighting the importance of spectrum, praising network neutrality rules that the administration implemented in 2010 and noting that investment in networks has not fallen because of them and paying lip service to the need for the FCC to ensure that broadband markets remain competitive through ?light-touch? regulation.
Where it got interesting was when Genachowski appeared to admit something we said two and half years ago ? that his plan to cover 100 million homes with speeds of 100 Mbps or more by 2020 was a pretty low bar. Now he is calling for faster speeds because when compared with the rest of the world 100 Mbps is?fairly?middle of the road.
He then called for faster broadband and lauded the creation of faster gigabit networks being built in Kansas City by Google and the creation of an all fiber-to-the-home network in Chattanooga, Tenn. But because he?s still doing the ?Julius shuffle? he stopped short of calling on cable companies and telcos to deploy gigabit networks. He also called for higher-capacity pipes so everyone in a multi-person home could download video or partake of high speed internet services, but didn?t mention issues like data caps which could stifle such household use of HD video. Finally he called for ubiquitous broadband that would incorporate mobile and wireline access.
His speech, combined with questions the FCC sent out in August relating to how it measures broadband have me wondering if we?ll soon see a more nuanced series of metrics for measuring broadband. Right now speed is pretty much the sole arbiter of broadband ? if you offer 4 Mbps down and 1 Mbps up you provide broadband.
But under the new broadband math, it appears that the FCC is saying that speed isn?t enough and that maybe that speed isn?t even all that impressive when considering the applications people want to run over these networks. Perhaps the FCC is ready to think about whether a 30 Mbps service that comes with a 100 GB a month cap should count as broadband. It?s certainly asking if such a service should rank equally with a 30 Mbps uncapped service in its notice of inquiry from August.
Already the comments from consumers and the industry in response to the FCC?s questions has elicited the usual arguments with ISPs saying that the FCC should stop saying the U.S. isn?t deploying broadband in a reasonable and timely fashion and pointing out that places like New York have 300 Mbps service from cable and fiber to the home from Verizon, while ignoring that there are still plenty of areas where a consumer can only choose between 3 or 6 Mbps DSL and a capped cable subscription. Satellite providers are understandably leery of classifying broadband at speeds that might be higher than their services could deliver, while consumers spent a lot of timing pointing out that caps are a huge problem.
If the FCC does take a look at raising or looking at different broadband metrics, I wonder if price might also factor into play. In one line of his speech Genachowski pointed out that americans tend to subscribe to lower speed tiers than their counterparts in Japan and Korea and wondered if higher prices for broadband might be to blame. For a regulator so adept at doing the ?Julius shuffle?, such a comment seemed pretty aggressive, although short of more competition it?s unclear how pricing could possible change.

Edmonds is one of five communities in Washington state in the running to be named one of the ?Prettiest Painted Places in America.?
In partnership with the Edmonds Chamber of Commerce, Jeff Stilwell of the Edmonds Mural Society entered Edmonds in the Prettiest Painted Places contest. Sponsored by the Paint Quality Institute, whose mission is to educate the public about quality paints and coatings, the ?Prettiest Painted Places? competition has drawn five entries from Washington: Coupeville, Edmonds, Leavenworth, Port Townsend, and Vashon-Maury Island.
During the next few weeks, the five Washington communities will vie with nearly 200 nominees from other states for regional and national honors, as judges with expertise in color selection, exterior painting, and home improvement review the entries, conduct additional research and make selected site visits. Finalists will be announced in late September, and the nation?s 12 ?Prettiest Painted Places? will be revealed in mid-October.
The Paint Quality Institute has conducted its competition twice before, most recently in 2000. A wide variety of ?places? have been entered in the competition. Nominees range from well-known places, such as Cape Cod, Mass. and Napa, Calif. to hidden gems like Bell Buckle, Tenn. and Holly Springs, Miss.
The names and locations of all of the nominees are posted on the Paint Quality Institute website at blog.paintquality.com.
The Edmonds Mural Society began in the fall of 2009 with the raising of its first mural, ?A Day in Edmonds,? by Pat Brier. Funds to support the murals come from the 200-plus supporting members of the Edmonds Mural Society.

EDWARDS AIR FORCE BASE, California (Reuters) - The space shuttle Endeavour, carried piggyback atop a jumbo jet, landed at Edwards Air Force Base in California on Thursday at the tail end of a cross-country trip to Los Angeles to begin its final mission as a museum exhibit.
The specially modified Boeing 747 with the newly retired spaceship perched on its back touched down safely at 12:50 p.m. local time (3:50 p.m. EDT) at Edwards, about 100 miles north of Los Angeles in the Mojave Desert.
NASA retired its shuttle fleet last year after completing the U.S. portion of the $100 billion International Space Station, a permanently staffed research complex that is owned by 15 nations and orbits about 250 miles above Earth.
Endeavour embarked on its last cross-county "ferry" journey on Wednesday from Cape Canaveral, Florida, and made several low-altitude passes over NASA centers in Mississippi, Louisiana and Texas before stopping for the night at Ellington Field near the Johnson Space Center in Houston.
The trip resumed early on Thursday, with Endeavour and its carrier jet making additional flyovers - one over Tucson, Arizona, in a salute to former Congresswoman Gabrielle Giffords and her husband, Mark Kelly, the retired astronaut who commanded Endeavour's final flight on his last mission in late May 2011.
Giffords, still recuperating from a gunshot wound to the head suffered in an attempt on her life last year, watched the flyover from the roof of a Tucson parking garage with her husband and mother, according to former aide C.J. Karamargin, who joined them.
"When it came into view, Mark said, 'There's my spaceship!'" Karamargin recounted. "Gabby was just elated, hooting and hollering like the rest of us were."
From Arizona, Endeavour and its carrier jet flew on to California, where the spacecraft was built two decades ago, for the landing at Edwards Air Force Base.
The sprawling installation used to serve as the primary landing site for NASA's shuttle program before the space agency built a landing facility for the orbiters at the Kennedy Space Center in Florida. Edwards then became the principal backup landing spot for shuttles in case of bad weather at Cape Canaveral.
Endeavour made seven landings at Edwards during its active tenure at NASA, most recently in November 2008.
FINAL FLIGHT
The shuttle was scheduled to depart Edwards on Friday for its very last ferry flight, and the final airborne journey of the entire space shuttle fleet, headed for Los Angeles International Airport.
The 75-ton (68-tonne) winged spacecraft will then undergo preparations to be moved next month through city streets from the airport to its permanent home at the California Science Center in downtown Los Angeles, where the shuttle will be put on public display starting October 30.
To make way for the mammoth orbiter along its 12-mile route to the museum, crews are cutting down nearly 400 trees, raising overhead utility wires and temporarily removing hundreds of utility poles, street lights and traffic signals. The science center has agreed to plant 1,000 new trees to replace those slated for removal.
Endeavour was built as a replacement for Challenger, the shuttle lost in a 1986 launch accident that killed seven astronauts. It went on to fly 25 missions, including 12 to build and outfit the space station, and logged nearly 123 million miles (198 million km) in flight during 4,671 orbits.
Endeavour is the second of NASA's three surviving shuttles to be sent to a museum. Discovery, NASA's oldest surviving shuttle, is on display at the Smithsonian Institution's Steven F. Udvar-Hazy Center outside Washington.
Atlantis, which flew NASA's 135th and final shuttle mission in July 2011, will be towed down the road to the Kennedy Space Center Visitor Complex in November.
NASA lost a fourth shuttle, Columbia, in another fatal accident in 2003. That shuttle was not replaced. A shuttle test vehicle, Enterprise, which has never flown in space, was delivered to a New York City museum.
On its way from Edwards to the Los Angeles airport, Endeavour will soar atop its carrier jet on several last victory laps over California, including flyovers above San Francisco, Sacramento, Hollywood and even Disneyland at Anaheim.
NASA said on Thursday evening that the spacecraft's scheduled departure from Edwards had been delayed by one hour until 8:15 a.m. local time (11:15 a.m. EDT) on Friday due to forecasts of low clouds and fog in the San Francisco Bay Area. Its expected arrival time at LAX was updated to about 12:45 p.m. local time.
